Terms and Conditions of Sale

1. Purpose and acceptance

These General Terms and Conditions of Sale (hereinafter, the "Conditions") govern the purchase of access control turnstiles, barriers, control electronics, and other products and accessories (hereinafter, the "Products") offered through the online store of IDENTIFICA-T ACCESOS Y PRESENCIA SL (hereinafter, "Identifica-T" or "the Seller").

Placing an order implies full reading and acceptance, without reservations, of these Conditions. Identifica-T may modify them at any time; the version in force on the date of the order will apply.

The Products are described in the corresponding sheet of the online store, including technical specifications, indicative images, and price. Identifica-T strives to ensure that the information is accurate, although there may be minor design variations compared to the images due to manufacturer updates.

Availability is shown on each product sheet. If a Product is out of stock after confirming the order, the customer will be informed by email and an equivalent alternative, extended delivery time, or cancellation with a full refund will be offered.

4. Prices and taxes

Prices are indicated in euros (€) and include the applicable VAT, unless expressly stated "+ VAT" on the product sheet, in which case the tax will be added during the purchase process. Shipping costs are shown itemised before confirming the order.

For orders with installation or custom configuration (e.g. ITStart Torno packs, ITControl Premium), the final price may vary according to the agreed specifications and will be confirmed by prior quotation.

5. Purchase process and order confirmation

The customer selects the Products, reviews the order summary (Products, quantities, price, shipping costs, and delivery details) and confirms the purchase. After payment, Identifica-T sends a confirmation email with the order receipt. This confirmation does not imply acceptance if a manifest error in price or availability is detected, in which case the customer will be contacted.

6. Payment methods

The payment methods indicated at the online store checkout are accepted (credit/debit card, bank transfer, or others that are enabled). All card payments are processed through a secure payment gateway; Identifica-T does not store card data.

For custom configured control electronics orders or installation projects, Identifica-T may request a deposit before starting the manufacturing or configuration of the order.

7. Shipping and delivery times

Identifica-T ships to Spain and the rest of the European Union. The estimated delivery time is indicated on the product sheet or in the quote, and starts counting from the confirmation of payment.

The timeframes are indicative and may vary due to reasons beyond the Seller's control (carrier incidents, customs for shipments outside of mainland Spain, manufacturer stock). Identifica-T will inform of any relevant delays.

The risk of loss or damage to the Product is transferred to the customer at the moment of delivery to the indicated address. It is recommended to check the condition of the package before signing for receipt and to note any anomalies.

8. Right of withdrawal and return policy

In accordance with Royal Legislative Decree 1/2007 (Consolidated Text of the General Law for the Defence of Consumers and Users), the consumer customer has 15 calendar days from the receipt of the Product to withdraw from the purchase without the need for justification, notifying Identifica-T by email or through the withdrawal form. This period exceeds the legal minimum of 14 calendar days.

8.1. Conditions of return

Depending on the condition of the Product, the following will apply:

  • Unopened Product: the full amount will be refunded via bank transfer.
  • Opened or assembled Product but unused: the customer retains their right to a full refund. However, the customer is liable for the decrease in value of the Product resulting from handling that is not necessary to ascertain its nature, characteristics, and functioning (art. 108.2 TRLGDCU). In such cases, Identifica-T may deduct from the refund the amount corresponding to that decrease in value, following a justified technical assessment that will be communicated to the customer.

All refunds will be made by bank transfer, within a maximum of 14 days from the receipt of the returned Product or from when the customer proves its dispatch. The return costs are borne by the customer, unless the reason is a defect or error attributable to Identifica-T.

8.2. Products excluded from return

By their nature, the following are excluded from the right of withdrawal, in accordance with art. 103 of the TRLGDCU:

  • Customised products, configured or manufactured according to the customer's specifications (for example, bespoke programmed electronics or ITControl solutions with specific parameterisation).
  • Services already rendered, including installation, configuration, or technical support provided.
  • Items that are part of joint promotions, packs, or combinations: partial returns of only one of the products are not accepted; it will be necessary to return the complete set or combination.

These return conditions do not affect the rights that the legal warranty recognises to the consumer (RDL 1/2007), detailed in section 9.

9. Warranty

9.1. Warranty for consumers (B2C)

The Products come with the legal warranty of 3 years provided for new goods in the TRLGDCU (art. 120), with Identifica-T being responsible for any lack of conformity that arises during that period.
The warranty does not cover damages resulting from improper use, handling by unauthorised personnel, incorrect installation not carried out by Identifica-T or its installers, normal wear and tear, or environmental conditions outside the manufacturer's technical specifications.

9.2. Warranty for businesses (B2B)

For business customers, the Products come with a warranty of 12 months from receipt, in accordance with the Spanish Civil Code (arts. 335-345). During this period, Identifica-T is responsible for any lack of conformity that arises under normal conditions of use.
The B2B warranty does not cover: damages from improper use, modifications or repairs carried out by unauthorised third parties, wear from continuous operation, extreme environmental conditions outside technical specifications, or damages resulting from falls, impacts or exposure to prohibited humidity/temperature.
For installation, integration or custom solution projects (ITControl Premium, special configurations), the warranty terms may vary and will be specified in the budget and specific contract prior to execution.

9.3. Warranty claim procedure

For both categories, the customer must contact the Technical Support Service (SAT) of Identifica-T through the channels indicated in section 2, providing evidence of the defect (photographs, detailed description, product serial number). Identifica-T will evaluate the incident within a maximum of 5 working days and will offer repair, replacement or refund as appropriate.

Identifica-T reserves the right to inspect the Product to verify that the defect is attributable to a manufacturing fault and not to the aforementioned exclusion causes.

10. Installation and commissioning

When the order includes installation service, this will be coordinated with the customer after the delivery of the hardware. Self-installation kits (such as ITStart Kit) are sent preconfigured along with instructions; remote technical support is included during the period indicated in the product sheet.

11. Liability

Identifica-T shall not be liable for damages resulting from use of the Product contrary to its purpose, installations carried out by unauthorised third parties, or force majeure causes. The Seller's liability to the customer is limited, in any case, to the amount actually paid for the Product.

12. Intellectual and industrial property

The contents of the online store (texts, images, brands, logos, ITConnect software) are the property of Identifica-T or its licensors and are protected by intellectual and industrial property regulations. Reproduction or use without express authorization is prohibited.

13. Data protection

The personal data provided during the purchase is processed in accordance with Regulation (EU) 2016/679 (GDPR) and the LOPDGDD, for the purpose of managing the order, billing, shipping and, where applicable, warranty and after-sales support. The customer can exercise their rights of access, rectification, deletion and others provided for in the regulations by writing to info@identifica-t.com.

14. Applicable law and jurisdiction

14.1. For consumers (B2C)

These Conditions are governed by Spanish legislation. For any dispute arising from these Conditions, the consumer customer may go to the Courts and Tribunals of their domicile or to those competent for the location of Identifica-T (Coín, Málaga), at their choice. Without prejudice to the above, the customer may go to the European online dispute resolution platform (ODR): https://ec.europa.eu/consumers/odr.

14.2. For businesses (B2B)

For business customers, these Conditions are governed by Spanish legislation. Both parties submit exclusively to the Courts and Tribunals of Málaga (Spain), waiving any other jurisdiction that may correspond to them.
